These Terms govern your use of Promspark.com and purchases made through the Promspark storefront and Shopify checkout.

1. Agreement
Accepting these Terms
These Terms are an agreement between you and CUIHUA TRADING CO., LIMITED ("Promspark," "we," "us," or "our"). By visiting, using, or buying through the website, you agree to them. If you do not agree, do not use the website or place an order.
2. Store use
Online store, eligibility, and minors
Permitted use
You may use the storefront only for lawful, personal shopping and related customer-service purposes.
Eligibility
You represent that you can enter into a binding agreement. If you are under the age of majority where you live, a parent or legal guardian must review and accept these Terms and place or authorize the order.
Account security
Keep account credentials confidential and promptly notify support if you believe your account has been used without authorization.
3. Products
Descriptions, images, color, pricing, and availability
Product information
We work to present products accurately. Images, lighting, screens, fabrics, hand-finishing, and production batches can create reasonable variation in color, texture, placement, and appearance.
Pricing and availability
Prices are shown in the checkout currency unless stated otherwise and may change before an order is accepted. Products, options, and quantities may be unavailable or limited.
No guarantee of exact display
Product images and descriptions are guides, not a guarantee that a dress will appear exactly the same on every screen or in every light.
4. Product options
Custom sizing, order timing, and delivery estimates
Product options and order timing
Available color, size, and personalization options can vary by product. Review the selected product and checkout information before ordering; order timing is not the same as immediate warehouse fulfillment.
Measurements
You are responsible for supplying accurate measurements and confirming the chosen size or custom-size details. We are not responsible for fit issues caused by incorrect, incomplete, or changed measurements provided by you.
Timing
Production and delivery dates are estimates, not guarantees. They may change because of customization, materials, carrier events, destination, customs, or other factors outside our reasonable control.
5. Orders
Payments, acceptance, changes, and cancellations
Checkout and acceptance
Shopify processes checkout, payments, taxes, and order confirmation. A receipt or authorization does not itself mean we have accepted an order. We may decline, limit, or cancel an order where permitted, including for suspected fraud, pricing errors, or availability issues.
Order changes
Contact support as soon as possible if you need a change or cancellation. Once production, personalization, or shipment has started, changes or cancellation may be unavailable or may involve charges permitted by applicable law.
Shipping
You are responsible for providing a complete and accurate delivery address. Carrier estimates, customs processing, and delivery events are outside our direct control after handoff to the carrier.
6. Returns
Returns, refunds, final sale, and excluded products
Returns and refunds
The applicable Shipping & Returns policy describes eligibility, timing, condition requirements, and the refund process. It is incorporated into these Terms.
Final sale
Custom-size, personalized, altered, clearance, intimate, or otherwise clearly marked final-sale items may not be returnable except where required by law or where an item is defective or materially not as described.
Review of issues
Contact support promptly with relevant order details and photos if a product arrives damaged, defective, or materially different from the confirmed order.
7. Programs
Promotions, discount codes, and the Promspark Student Program
Promotions
Promotions and discount codes are subject to their stated terms, may expire, may be limited by product or order, and cannot be combined unless we state otherwise. We may correct code, pricing, or technical errors.
Student Program
Student offers are available only to eligible participants and may require verification through Pion, Student Beans, Beans iD, or another stated verification provider. Eligibility, discount value, and availability may change or end as permitted by law.
Verification
Verification decisions are made by the verification provider under its own terms and privacy practices. Promspark does not receive or retain raw student identity documents when verification is handled by that provider.
8. Site rules
Intellectual property and prohibited uses
Our content
The website, designs, text, images, graphics, trademarks, and software are owned by or licensed to Promspark and protected by law. You may not copy, reproduce, scrape, sell, or exploit them without written permission.
Prohibited conduct
Do not misuse the site, interfere with security or checkout, submit false information, use automated extraction without permission, infringe rights, spread malware, or use the site for unlawful, abusive, deceptive, or fraudulent activity.
9. Third parties
Shopify and other services
The storefront uses Shopify for products, checkout, payments, orders, discounts, and related commerce services. We may also use shipping, fulfillment, verification, analytics, communication, and other service providers. Their services may have separate terms and privacy notices; we are not responsible for third-party sites or services beyond our control.
10. Legal terms
Disclaimers, liability, indemnity, and severability
Disclaimers
To the fullest extent permitted by law, the website and services are provided "as is" and "as available" without warranties of any kind, except warranties that cannot legally be excluded.
Limitation of liability
To the fullest extent permitted by law, Promspark and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Where liability cannot be excluded, it is limited to the amount you paid to us for the applicable order during the period allowed by law.
Indemnification and severability
You will indemnify Promspark against claims arising from your unlawful use or breach of these Terms. If a provision is unenforceable, the remaining provisions continue to apply.
11. Ending use
Termination and changes
We may suspend or end access to the site or services where reasonably necessary, including for breach, fraud, security, or legal compliance. We may update these Terms by posting a revised version with a new last-updated date. Continued use after an update means you accept the revised Terms to the extent permitted by law.
12. Governing law and contact
Where these Terms apply
These Terms are governed by the laws of Hong Kong Special Administrative Region of the People's Republic of China, without regard to conflict-of-law rules, except where consumer protection law requires otherwise.
